Terms of Service

1. Agreement
These Terms of Service govern your access to and use of Carbon — the analytics service available at oncarbon.site, including the dashboard, the ingest API, and the Carbon SDK (together, the “Service”). By creating an account or using the Service, you agree to these terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to it.
2. The Service
Carbon records LLM calls and tool calls made by your applications as structured events and provides analytics over them: usage, cost, latency, and errors, sliced by agent, model, user, thread, and tool. The Service is provided as a hosted product; we may improve or modify features over time.
3. Accounts
You need an account to use the Service. Authentication is handled through our identity provider. You are responsible for activity that occurs under your account and for keeping your credentials secure. You must provide accurate account information and be at least 16 years old.
4. API keys
API keys authenticate your applications with the ingest API. You are responsible for safeguarding your keys and for all events submitted with them. If a key is compromised, revoke it in the dashboard immediately; events accepted before revocation remain in your space.
5. Your data
You retain all rights to the data your applications send to Carbon, including prompts, model outputs, tool inputs and outputs, and the identifiers you attach to events (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide the Service. You are responsible for ensuring you have the necessary rights and consents to send Customer Data to Carbon, including any end-user data it contains.
6. Acceptable use
You agree not to:
- use the Service to violate any law or the rights of others;
- attempt to gain unauthorized access to the Service or other customers' data;
- probe, disrupt, or overload the Service outside documented limits;
- resell or provide the Service to third parties as your own offering without our agreement;
- submit data you do not have the right to process.
7. Plans and billing
Carbon offers free and paid plans. Current pricing, included usage, and overage rates are described on our pricing page and in the dashboard. Depending on your plan, usage beyond your allowance is either rejected or billed. Payments are processed by our payment provider; by subscribing you authorize recurring charges. Plan upgrades take effect immediately. If you cancel a paid plan, it remains active until the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice.
8. Availability
We aim to keep the Service available and your events durable, but the Service is provided without an uptime guarantee. Event ingestion is acknowledged when events are durably queued; processing is asynchronous. We may suspend the Service for maintenance, security, abuse prevention, or non-payment.
9. Intellectual property
The Service, including its software, design, and documentation, is owned by us and our licensors. These terms grant you no rights to our trademarks or branding. Feedback you provide may be used to improve the Service without obligation to you.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Analytics, including model cost estimates, are provided for informational purposes and may contain inaccuracies.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, or data. Our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months preceding the claim.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for material breach of these terms, including non-payment or abuse. Upon termination we will delete Customer Data within a reasonable period, except where retention is required by law.
13. Changes to these terms
We may update these terms from time to time. Material changes will be announced through the Service or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These terms are governed by the laws of the jurisdiction in which the Carbon operator is established, without regard to conflict of laws principles.
